             Planning & Building Dept.

Date:     November 7th, 2005                                 No.             10.3

ITEM:

Approval of the Final Plat for Prairie Creek Acres Subdivision, Application #0509-551, Rod Stockard., located at the intersection of Finney Terrace and U.S. Highway 59 on the South side of Finney Terrace and on the West side of U.S. Highway 59.

BACKGROUND:

The applicant proposes to divide approximately 33.42 acres into two (2) residential lots.  The Planning Commission recommended approval of the rezoning from A-1 (Agriculture) to R-3A (Single Family Residential Three Acre) at their meeting of September 16th of this year.

Lot #1 will be 3.24 acres and Lot #2 will be 30.18 acres.  Both lots will share a common access easement that is 50’ X 50’ in size and will front onto Highway 59.  Both lots meet the minimum standards required by the County Zoning and Subdivision Regulations, including lot size, lot frontage and lot length-to-width ratio.

The existing residence would be located on Lot #1 and is currently served with on-site sanitation and public water.

Lot #2 meets the minimum requirements, which permits on-site water and sanitation (wells/lagoons) for a future residence.

Article 2, Section 5.01 of the County Subdivision Regulations permits the Planning Director to waive the Preliminary for “small subdivision plats” consisting of not more than four (4) lots and where all lots have direct frontage onto County or State maintained roads and no new roads are required or proposed.  Therefore, the subdivision plat for Prairie Creek Acres has been filed as provided in Article 2, Section 3 of the County Subdivision Regulations.  Public Notice is not required.

PLANNING COMMISSION RECOMMENDATION:

The Planning Commission recommended approval of Prairie Creek Acres Subdivision, Application #0509-51.

STAFF RECOMMENDED ACTION:

Staff recommends that the Board of County Commissioners authorize the Chairman to endorse the Final Plat for Prairie Creek Acres Subdivision.
