BOARD OF FRANKLIN COUNTY COMMISSIONERS
Chairman Donald R. Stottlemire called the meeting to order at 8:30 and asked all in attendance to join him in the Pledge of Allegiance.
Roll Call: Chairman Donald R. Stottlemire present, Commissioner John E. Taylor present, Commissioner Donald C. Hay present, Commissioner Roy C. Dunn present and Commissioner Donald E. Waymire present.
Commissioner Hay moved and Commissioner Waymire seconded to approve the minutes for June 27, 2005. All voted “yes.”
Commissioner Taylor moved and Commissioner Hay seconded to approve tax change orders 2004-232 through 2004-236. All voted “yes.”
Les Reinier of 4608 Butler Terr. discussed the appointment of Robert Wilson as the Pottawatomie Township Clerk and said he was part of the group that filed a petition to recall him from the position of Pottawatomie Township Trustee which the County Attorney denied. It would be hard to work with him to better the township with him on the Board, which the Commission should be able to understand.
Jim Luther of 251 Utah Terr. said he was disturbed when he read the paper about the Board reconsidering the appointment of Robert Wilson to the Pottawatomie Township Board. He asked the Board to leave him appointed.
Ray Tomberlin of 3072 Labette Terr represents 19 home owners who have an agreement with the County to hard surface Labette Terr west from Nebraska Rd to dead end and Nebraska Rd from 2773 to 2900. They were told that the base would be done in the fall, which it was and that the first chip and seal would be done in the spring and the second chip and seal would be done in the fall of this year. There is nothing going on at this time. Blaine Finch said that they had planned to include the bid in the 36 mile project and that the 36 mile project is going to be asphalt after the bids were taken and approved. Board agreed that they wanted the chip and seal to be done as soon as the bids could be let. Blaine is going to talk with Jim Haag and Ron Henrickson.
Ken Froggatte of 3226 Labette Terr. said that someone needs to look into why Labette is damaged when we get heavy rains. Mr. Froggatte said it is because of the pond that is located near the road.
Gene Maxwell of 3165 Labette Terr. said that riprapping the east side of the bridge would save the road from washing out when we get heavy rains.
Joe Ream of 3219 Labette Terr. said the chuck holes need to be fixed before hard surfacing the benefit district.
Ken Froggatte said the benefit project will happen this year. Board agreed and will talk to Jim Haag immediately.
Joe Ream said they were told one chip seal would be done in the spring and the second in the fall.
Board asked Blaine Finch for his opinion of the statues on appointments for township boards. Blaine said that all vacancies are appointed by the Board of County Commissioners and that the Board had already appointed Robert Wilson as the Pottawatomie Township Clerk.
Commissioner Dunn moved and Commissioner Waymire seconded to adopt the agenda. All voted “yes.”
Commissioner Hay moved and Commissioner Taylor seconded to the consent agenda item 8.1 amendment of the agreement with Aquaterra in the amount of $7,500 and item 8.2 to pay 2006 Lake Region Solid Waste Authority dues in the amount of $4,766. All voted “yes.”
With no further discussion the meeting was adjourned at 9:30.
