BOARD OF FRANKLIN COUNTY COMMISSIONERS
Chairman Donald R. Stottlemire called the meeting to order at 8:30 and asked all in attendance to join him in the Pledge of Allegiance.
Roll Call: Chairman Donald R. Stottlemire present, Commissioner John E. Taylor present, Commissioner Donald C. Hay present, Commissioner Roy C. Dunn present and Commissioner Donald E. Waymire present.
Commissioner Hay moved and Commissioner Dunn seconded to approve the minutes for June 29, 2005. All voted “yes.”
Commissioner Taylor moved and Commissioner Waymire seconded to approve tax change orders 2004-237 through 2004-239. All voted “yes.”
Commissioner Waymire moved and Commissioner Dunn seconded to increase mileage reimbursement from .37 cents to .40 cents effective July 1, 2005. All voted “yes.”
Board discussed 2006 Holidays and will discuss again at a later date.
Alan Radcliffe updated Board on disaster status damage to county from recent storms.
Jim Haag discussed additional roadway overlay work.

Larry Walrod discussed revoking of septic service license from Robert Brown. Mr. Brown had asked to be placed on the agenda, but did not show.
Commissioner Hay moved and Commissioner Dunn seconded to adopt the agenda. All voted “yes.”
Item 10.1 Larry Walrod discussed Special Use Permit application #0505-487, Faulk & Foster, for the construction and operation of a communication tower located on the North side of Clark Rd. between Highway 59 and Nebraska Rd. Planning Commission recommended approval.
Commissioner Taylor moved and Commissioner Hay seconded to approve Resolution No. 05-64 approving a Special Use Permit Application #0505-487 Faulk & Foster to permit the construction and operation of a 300 foot high communication tower in an A-1 zone located in Section 6, Township 19, Range 20 with the following conditions: 1) That they guy anchors and tower base be enclosed with a 6’ high chain link fence with security barbed wire. Access to the enclosed area shall be locked at all times except when being used by company employees, 2) That lighting on the tower shall be in compliance with Federal Aviation Administration lighting standards, 3) That the communication facilities comply with all requirements of the Federal Communication Commission, 4) That a sign be placed on the security fence around the tower base to include a telephone number of a responsible party in the event of an emergency, 5) That the tower base, guy anchor areas and access easement be kept free of noxious weeds, litter and debris, 6) That the tower and related facilities comply with the County Building Codes and Permits, 7) That the applicant agrees to provide space on the tower at 150’ elevation or higher for County emergency and safety users, at no cost to the County, in the event that such services are deemed necessary to provide service to Franklin County, 8) That the applicant agrees to remove the tower when it is no longer required and 9) That the Special Use Permit shall be null and void by operation of law if said permit has not been initiated and utilized by commencing the activity or use at the site specified in said permit within one (1) year of the date of approval. All voted “yes.”
Item 10.2 Larry Walrod discussed rezoning application #0505-501 for Killough, to rezone from an I-1 to an I-2 property located near the intersection of Montana Rd. and Osborne Terr. on the South side of Osborne Terr. and East of Montana Rd.
Item 10.7 Larry Walrod discussed a Special Use Permit application #0505-502 for Killough, for the operation of a welding shop, tire shop, mechanical shop, recycling center and salvage facility in I-2 zoning, located near the intersection of Montana Rd. and Osborne Terr. on the South side of Osborne Terr and East of Montana Rd. Larry stated the Planning Commission recommended approval of the rezoning application and the special use permit.
Commissioner Hay moved and Commissioner Waymire seconded to approve Resolution No. 05-65 rezoning of a tract of land owned by Bo Killough and located in Section 30, Township 16, Range 20 from I-1 to I-2. All voted “yes.”
Commissioner Hay moved and Commissioner Dunn seconded to approve Resolution No. 05-66 approving Special Use Permit Application #0505-502 (Killough) to permit the operation of a welding shop, tire shop, mechanical repair shop, recycling center and salvage facility in an I-2 zoning located in Section 30, Township 16, Range 20 with the following conditions: 1) That the applicant shall obtain appropriate building permits for any new construction or re-construction, 2) That the applicant shall hook up to the public sewer line for sanitation purposes, 3) That the operation shall be conducted wholly within a non-combustible building or within an area completely surrounded on all sides by a fence, wall or other screening. The fence, wall or other screening shall be uniform in height, ensure maximum safety to the public and preserve the general welfare of the neighborhood. The fence, wall or screening shall be installed in such a manner as to retain all scrap, junk or other material within the yard, 4) That no junk shall be loaded, unloaded or otherwise placed, whether temporarily or permanently, outside of the enclosed building, fence or wall or within the public right-of-way, 5) No junk, salvage, scrap or other materials shall be piled or stacked higher than the top of the required fence, wall or screening and 6) That the Special Use Permit shall become null and void by operation of law if the Special Use Permit has not been initiated and utilized by commencing the activity at the specified site within one (1) year of the date of approval. All voted “yes.”
Item 10.3 Larry Walrod discussed a Special Use Permit application #0505-503 for Stone, for the construction and operation of a dog kennel/breeding facility in an A-2 zoning district located on the South side of Osborne Terr. between Kentucky Rd. and Louisiana Rd. Larry stated the Planning Commission recommended denying the Special Use Permit.
Commissioner Taylor moved and Commissioner Waymire seconded to approve Resolution No. 05-67 denying the Special Use Permit Application #0505-503 for the operation of a dog breeding/kennel operation in an A-2 zoning located in Section 28, Township 16, Range 19. Chairman Stottlemire and Commissioners Dunn, Taylor and Waymire voted “yes.” Commissioner Hay abstained.
Item 10.4 Larry Walrod discussed a rezoning application #0504-473 for Rockhold, to rezone approximately 20 acres from an A-1 to A-2 located near the intersection of Sand Creek Rd. and Colorado Rd, on the South side of Sand Creek Rd. and the West side of Colorado Rd. Larry said the Planning Commission recommended approval.
Commissioner Dunn moved and Commissioner Waymire seconded to approve Resolution No. 05-68 rezoning approximately 20 acres from A-1 to A-2 located in Section 19, Township 16, Range 18 and owned by Keith Rockhold. All voted “yes.”
Item 10.5 Larry Walrod discussed a rezoning application #0505-494 for Hughes, to rezone approximately 10 acres from A-1 to R-E located on the West side of Tennessee Rd. and on the North side of Riley Rd. Larry stated the Planning Commission recommended approval.
Commissioner Hay moved and Commissioner Dunn seconded to approve Resolution No. 05-69 rezoning approximately 10 acres from A-1 to R-E located in Section 2, Township 16, Range 20 and owned by Roger Hughes. All voted “yes.”
Item 10.6 Larry Walrod discussed final plat application #0505-505 from Scott Ferguson, for Ferguson Acres No. 2 Subdivision to replat Lots #4 and #6 of Ferguson Acres No. 1 Subdivision reducing Lot #6 from 10 acres to 5 acres located at the intersection of Montana Rd. and Stafford Terr. on the South side of Stafford Terr. and East of Montana Rd.
Commissioner Taylor moved and Commissioner Hay seconded to authorize the Chairman to sign the final plat of Ferguson Acres No. 2 Subdivision. Chairman Stottlemire and Commissioner Hay, Taylor and Waymire voted “yes.” Commissioner Dunn abstained.
Item 10.8 Larry Walrod discussed rezoning application #0504-474 for Madl, to rezone approximately 19.81 acres from A-1 to R-E and 35.23 acres from A-1 to A-2, located near the intersection of Woodson Rd. and Ohio Rd. on the South side of Woodson Rd. and the East side of Ohio Rd. Larry stated the Planning Commission recommended approval.
Commissioner Dunn moved and Commissioner Waymire seconded to approve Resolution No. 05-70 rezoning approximately 19.81 acres from A-1 to R-E and approximately 35.23 acres from A-1 to A-2 located in Section 22, Township 15, Range 20 and owned by Ted Madl. All voted “yes.”
Commissioner Hay moved and Commissioner Taylor seconded to approve a lease agreement between the Board of County Commissioners and Dr. Kenneth J. Frank for a 10x12 room at the Franklin County Records and Research Center at a cost of $55 per month commencing July 1, 2005. All voted “yes.”
Ron Henrickson discussed decorating the HR/Administrator suite at the Annex.
With no further discussion the meeting was adjourned at 10:25.
