BOARD OF FRANKLIN COUNTY COMMISSIONERS

 

Chairman Roy C. Dunn called the meeting to order at 8:30 a.m.

 

Roll Call: Chairman Roy C Dunn present, Commissioner Donald R. Stottlemire present, Commissioner Donald C. Hay present, Commissioner John E. Taylor present and Commissioner Karen S. Farrell present.

 

Chairman Dunn asked all in attendance to join in the Pledge of Allegiance.

 

Invocation by Reverend Robert Louden with North Baptist Church.

 

Robert Douthat 1601 S. Hickory, Ottawa discussed executive session that was held a couple of weeks ago with Tom Weigand and Jerry Thompson and The Rumford’s and the taking of their property.

 

Della Sandgren 2408 Brushcreek Dr., Lawrence discussed she is not an absentee land owner and appraisals of property.

 

Don Hay discussed Robert’s Rules of Order and the democratic process.

 

Commissioner Taylor moved and Commissioner Stottlemire seconded to approve the consent agenda as follows: minutes for March 28, 2007 and tax change orders 2006-255 through 2006-260.  All voted “yes.”

PROCLAMATION

07-001

Fair Housing Month

 

Issued by the County Commissioners

County of Franklin County

 

                WHEREAS,  the Congress of the United States passed the Civil Rights Act of 1968, of which Title VIII declared that the law of the land would now guarantee the rights of equal housing opportunity; and

 

                WHEREAS, the County of Franklin is committed to the mission and intent of Congress to provide fair and equal housing opportunities for all, and today, many realty companies and associations support fair housing laws; and

 

                WHEREAS, the Fair Housing groups and the U.S. Department of Housing and Urban Development have, over the years, received thousands of complaints of alleged illegal housing discrimination and found too many that have proved upon investigation to be violations of the fair housing laws; and

 

                WHEREAS, equal housing opportunity is a condition of life in our County that can and should be achieved,

 

The Board of Franklin County Commissioners, of Franklin County on behalf of its citizens, do hereby proclaim the month of April as

 

FAIR HOUSING MONTH

 

                And express the hope that this year’s observance will promote fair housing practices throughout the County.

 

Commissioner Stottlemire moved and Commissioner Hay seconded to approve Proclamation No. 07-001 proclaiming the month of April as Fair Housing Month.  All voted “yes.”

 

Rick Sawin discussed contract for Noxious Weed Control on State right of way.

 

Commissioner Hay moved and Commissioner Taylor seconded to approve an agreement with Kansas Department of Transportation Bureau of Construction and Maintenance to treat Noxious Weeds on State Highway Rights-of-Way within Franklin County.  All voted “yes.”

 

Jim Haag discussed a Service and Repurchase Agreement with Martin Tractor Company for a 140H Caterpillar Motor Grader.

Commissioner Hay moved and Commissioner Farrell seconded to approve a Service and Repurchase Agreement with Martin Tractor Company for a 2007 Caterpillar 140H Motor Grader.  All voted “yes.”

 

Larry Walrod discussed rezoning application #0701-707 filed by Donna Burkdoll and property owner being Jeremy Altic to rezone approximately 47.97 acres from A1 to A2 and rezone approximately 13.1 acres from A1 to RE located on the South side of Riley Rd. between US 59 Hwy and Montana Rd.

 

Commissioner Hay moved and Commissioner Taylor seconded to approve Resolution No. 07-016 rezoning approximately 47.97 acres from A1 to A2 and approximately 13.1 acres from A1 to RE owned by Jeremy Altic located in Section 12, Township 16, Range 19.  All voted “yes.”

 

Larry Walrod discussed Grant of Easement between Franklin County and Jeremy L & Laura Altic.

 

Commissioner Hay moved and Commissioner Taylor seconded to accept a Grant of Public Road and Utility Easement from Jeremy L. & Laura Altic located in Section 12, Township 16, Range 19.  All voted “yes.”

 

Larry Walrod discussed a Special Use Permit #0702-710 for Jim Robinson for the storage and selling of processed Bison Meat located on the North side of Finney Rd. between Florida Rd. and Georgia Rd.

 

Commissioner Taylor moved and Commissioner Stottlemire seconded to approve Resolution No. 07-017 approving a Special Use Permit Application to permit the storage and selling of processed Bison meat located in Section 15, Township 18, Range 18 owned by Jim Robinson with five conditions.  All voted “yes.”

 

Larry Walrod discussed a Special Use Permit #0702-713 filed by Prairie Star Ranch with property owner being Roman Catholic Archdiocese of Kansas City for the placement of additional housing and outbuilding at a Church Youth Camp and Adult Retreat located North of Ellis Rd. between Hwy 50 and California Rd.

 

Commissioner Taylor moved and Commissioner Farrell seconded to approve Resolution No. 07-018 approving a Special Use Permit Application to permit the placement of additional housing and outbuildings at a Church Youth Camp and Adult Retreat located in Section 24, Township 18, Range 17 owned by Roman Catholic Archdiocese with seven conditions.  All voted “yes.”

 

Board recessed at 9:25.  Back in session at 9:35.

 

Larry Walrod discussed Special Use Permit Application #0702-718 for New Horizon Ranch, Inc. property owner being Gerald & Bonnie Miller for the operation of an outdoor lighted arena located near the intersection of John Brown Rd. and Vermont Rd. on the West side of Vermont Rd. and South of John Brown Rd.

 

Commissioner Taylor moved and Commissioner Stottlemire seconded to approve Resolution No. 07-019 approving a Special Use Permit Application to permit the operation of an outdoor lighted riding area owned by Gerald & Bonnie Miller located in Section 8, Township 18, Range 21 with nine conditions.  All voted “yes.”

 

Larry Walrod discussed rezoning application #0702-711 for Tim Duffy to rezone approximately 15.71 acres from A1 to RE located on the North side of Shawnee Rd. between Utah Rd. and I-35.

 

Commissioner Stottlemire moved and Commissioner Farrell seconded to approve Resolution No. 07-020 rezoning approximately 15.71 acres from A1 to RE owned by Timothy & Carol Duffy located in Section 32, Township 15, Range 21.  All voted “yes.”

 

Larry Walrod discussed rezoning application #0702-716 for Edward & Melody Calvert to rezone approximately 20 acres from A2 to R3A located at the intersection of Shawnee Rd. & Texas Rd. on the North side of Shawnee Rd. and on the West side of Texas Rd.

 

Commissioner Taylor moved and Commissioner Hay seconded to approve Resolution No. 07-021 rezoning approximately 20 acres from A2 to R3A owned by Edward & Melody Calvert located in Section 36, Township 15, Range 20.  All voted “yes.”

 

Larry Walrod discussed rezoning application #0702-717 filed by Orvel & Paula Calvert to rezone approximately 8.14 acres from A1 to RE located on the West side of Utah Rd. between Shawnee Rd. & I-35.

 

Commissioner Taylor moved and Commissioner Hay seconded to approve Resolution No. 07-022 rezoning approximately 8.14 acres from A1 to RE owned by Orvel & Paula Calvert located in Section 6, Township 16, Range 21.  All voted “yes.”

National Public Safety Telecommunications Week

April 8-14, 2007

 

Whereas emergencies can occur at anytime that require police, fire or emergency medical services;

 

And Whereas when an emergency occurs the prompt response of police officers, firefighters and paramedics is critical to the protection of life and preservation of property;

 

And Whereas Public Safety Telecommunicators are the first and most critical contact our citizens have with emergency services;

 

And Whereas Public Safety Telecommunicators are the single vital link for our police officers and firefighters by monitoring their activities by radio, providing them information and insuring their safety;

 

And Whereas Public Safety Telecommunicators of the Franklin County Sheriff’s Office have contributed substantially to the apprehension of criminals, suppression of fires and treatment of patients;

 

And Whereas each dispatcher has exhibited compassion, understanding and professionalism during the performance of their job in the past year;

 

Therefore Be It Resolved that the County Commission of Franklin County, Kansas declares the week of April 8 through 14, 2007 to be National Public-Safety Telecommunications Week in Franklin County, in Honor of the men and women whose diligence and professionalism keep our city and citizens safe.

 

Commissioner Stottlemire moved and Commissioner Taylor seconded to approve Proclamation No. 07-002 proclaiming April 8-14, 2007 to be National Public-Safety Telecommunications Week.  All voted “yes.”

 

Board discussed emergency medical services for the Wellsville area.

 

Marvin Hutchinson a Councilmember at Wellsville discussed land options for an Ambulance Station in Wellsville.

 

Nick Robbins discussed new ambulance vehicle options.

 

Commissioner Taylor moved and Commissioner Stottlemire seconded to adjourn the meeting at 10:15.
