RESOLUTION NO. 05-84

A RESOLUTION SETTING THE SALARY OF THE COUNTY CLERK

WHEREAS, Franklin County is a duly organized body politic imbued with the powers of home rule under K.S.A. 19-101a; and,

WHEREAS, the Board of County Commissioners is responsible for the management of the business and concerns of the county; and,

WHEREAS, the County Clerk was delegated the responsibility of acting as the county’s personnel officer and preparing the county payroll by the Board of County Commissioners on August 1, 1999; and,

WHEREAS, the County Clerk was paid an additional $5,400 per year for her acceptance of that additional work; and,

WHEREAS, the County Clerk was relieved of those duties by the Board of County Commissioners between August 2004 and March 2005; and,

WHEREAS, it is the policy of the Board of County Commissioners that no individual should receive compensation for duties he/she does not perform; and,

WHEREAS, the Supreme Court of the State of Kansas has ruled that no elected official has an expectation of a continued level of salary; and,

WHEREAS, the County’s wage and compensation study has determined that a reduction in the County Clerk’s salary will place the salary for that position in an equitable position compared to surrounding counties and other Franklin County elected officials; and,

WHEREAS, the County Clerk is bound by K.S.A. 19-302 to follow the county’s personnel policies and pay plan:

This resolution shall be effective upon its adoption by the Board of County Commissioners and its publication in the official county newspaper.
