RESOLUTION 05-124

 

A RESOLUTION INITIATING AN AMENDMENT TO THE FRANKLIN COUNTY ZONING REGULATIONS

 

WHEREAS, the Board of County Commissioners may initiate an amendment or revision to the zoning regulations of the County pursuant to K.S.A. 12-757(a), and

 

WHEREAS, the County has made no provision in its zoning regulations for the placement of sexually oriented businesses, and

 

WHEREAS, the Board of Commissioners desires to ensure that these types of businesses are subject to the lawfully enacted zoning regulations of Franklin County:

 

NOW THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIOENRS OF FRANKLIN COUNTY, KANSAS AS FOLLOWS:

 

1. The Board of Commissioners directs the Planning Commission to consider an amendment to the Franklin County Zoning Regulations as follows:

 

            Section 11-3. Special Uses

                        11-3.01

 

10. Sexually Oriented Businesses including but not limited to: adult book and/or video stores, adult novelty stores, any business that features or utilizes people in an unclothed or semi-clothed state including topless, gentlemen’s and strip clubs, and any other business that sells, offers to sell, or displays sexually explicit or graphic material. 

 

Section 11-8. Proximity  Restrictions

11-8.01 No sexually oriented business shall be placed within 1,000 feet of another sexually oriented business or within 1,000 feet of a school, daycare, or place of worship. Such distance shall be maintained so that at least 1,000 feet shall separate the lot on which the sexually oriented business stands from the lot on which any other sexually oriented business, school, daycare, or place of worship shall stand.

 

2. The Planning Commission is directed to hold all necessary public hearings and make a recommendation on the proposed amendment following its December 15, 2005, meeting.

 

This resolution shall take effect and be in force upon its adoption.
