RESOLUTION NO. 06-028
A RESOLUTION ESTABLISHING SEPTEMBER 30
OF EACH YEAR AS THE CUT OFF DATE FOR PROPERTY
SALES TO BE CERTIFIED BY THE COUNTY TREASURER
WHEREAS, Franklin County, Kansas is a county municipal government with the power of home rule pursuant to K.S.A. 19-101; and
WHEREAS, the County Clerk is required by K.S.A. 79-1803 to annually compute the final tax levy, upon certification of the next year’s tax levy by the state board of equalization, and deliver such to the County Treasurer on or before November 1 of each year; and
WHEREAS, a certain and reasonable amount of time is required to compute the final tax levy rate for each tract or lot of real property and the County Clerk’s office has determined that it can meet the statutory deadline if no property sales are certified after September 30 of each year.
WHEREAS, IT IS HEREBY RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS that September 30 of each year shall be the final date for sales of real property to be picked up and computed by the County Clerk for certification to the County Treasurer for inclusion in each current tax year’s statements.
IT IS FURTHER RESOLVED BY SAID BOARD that notice of such deadline shall be immediately posted in the offices of the Register of Deeds, County Appraiser, County Clerk and County Treasurer so as to give the public notice of the deadline.
