RESOLUTION   06 - 064

 

A RESOLUTION ADOPTING A FEE SCHEDULE

FOR THE FRANKLIN COUNTY JUVENILE DETENTION FACILITY

 

WHEREAS, K.S.A. 19-101, provides that a county may exercise the powers of home rule to determine its local affairs and government authorization under the provisions of K.S.A. 19-101a; and

 

WHEREAS, K.S.A. 38-1616(b)(3), provides that a county may seek reimbursement of funds spent to maintain, care or support an accused or adjudicated juvenile offender; and

 

WHEREAS, the reimbursement of county funds spent to maintain, care or support an accused or adjudicated juvenile offender is a permissible exercise of home rule power, pursuant to K.S.A. 19-101a; and,

 

WHEREAS, the Board of County Commissioners desires to adopt a policy to establish a fee schedule for the Franklin County Juvenile Detention Center for the maintenance, care and support of juveniles accused or adjudicated as juvenile offenders.  This schedule established the fees to be paid by the persons legally responsible for the care of support of accused or adjudicated juvenile offenders.

 

THEREFORE, BE IT RESOLVED

BY

  THE BOARD OF FRANKLIN COUNTY COMMISSIONERS,

 

That the attached Fee Schedule for the Franklin County Juvenile Detention Center is hereby adopted for accused and adjudicated juvenile offenders held in the Franklin County Detention Center.  This schedule shall not apply to juveniles in the custody or JJA, SRS or who are housed in the juvenile detention center for other counties.      

 

This fee schedule shall be effective immediately.

3rd Offense Doubles the Fee.  The first day in detention will be billed at the rate of $25.00 (Billable to Parent/Guardian).  This does not apply to juveniles in the custody or SRS/JJA or being held for other counties. 

 

Family size is calculated by the number of adults plus children residing at home.
