RESOLUTION NO. 07-013      

 

A RESOLUTION REVISING THE FRANKLIN COUNTY, KANSAS SUBDIVISION REGULATIONS IN ACCORDANCE WITH THE PROVISIONS OF K.S.A. 12-749.

 

WHEREAS, Franklin County, Kansas is a county municipal government, organized pursuant to Kansas Statutes K.S.A. 19-101; and

 

WHEREAS, the Franklin County Board of County Commissioners did by Resolution #23-91 creating the Franklin County Planning Commission as provided in K.S.A. 12-744; and

 

WHEREAS, the Franklin County Planning Commission did, by Resolution #97-51 dated December 8, 1997, adopt the Franklin County, Kansas Subdivision Regulations; and

 

WHEREAS, the Franklin County Planning Commission did cause a revision of the Franklin County, Kansas Subdivision Regulations, to be prepared as provided in K.S.A. 12-749; and

 

WHEREAS, the Franklin County Planning Commission published a notice on January 24, 2007, that a public hearing would be held to consider a revision of the Franklin County Subdivision Regulations, as required by K.S.A. 12-749; and

 

WHEREAS, the Franklin County Planning Commission did, on February 15, 2007, hold a Public Hearing for the consideration of adopting a revised County Subdivision Regulations as prescribed by K.S.A. 12-749; and

 

WHEREAS, the Franklin County Planning Commission, after due consideration of all written reports, and public testimony, did approve Resolution #08-2007, by unanimous vote of those members present, to revise Franklin County, Kansas Subdivision Regulations based on findings that such revisions were consistent with the goals and objectives of the County Comprehensive Plan, in the public interest and necessary to promote the health, safety and general welfare of the citizens of Franklin County, Kansas; and

 

WHEREAS, the Franklin County Board of County Commissioners, after duly reviewing said recommendation of the Planning Commission and considering all public comments and concerns regarding the revision to the Franklin County Subdivision Regulations finds the revisions to be in compliance with the provisions of K.S.A. 12-749 and necessary to support and promote the public health, safety and general welfare of the residents of the unincorporated areas of Franklin County, Kansas. 

 

NOW, THEREFORE, BE IT RESOLVED, that the Franklin County Board of County Commissioners does hereby approve the revised Franklin County Subdivision Regulations and does hereby approve the revised Franklin County Subdivision Regulations and does hereby incorporate, by reference, said revised regulations as provided in K.S.A. 12-3303 as if set out in full herein. 

 

 

 

 

PASSED AND ADOPTED by the Franklin County Board of County Commissioners this 7th day of March 2007.  This action shall become effective upon publication of this resolution in the official county newspaper.
