RESOLUTION   07 - 024

 

A RESOLUTION PROCLAIMING DISASTER AUTHORITY

WITHIN FRANKLIN COUNTY, KANSAS

 

WHEREAS, K.S.A. 19-101, provides that a county may exercise the powers of home rule to determine its local affairs and government authorization under the provisions of K.S.A. 19-101a; and

 

WHEREAS, the County finds that events may occur that produce certain conditions that cause, or eminently threaten to cause wide-spread damage, injury, or loss of life or property in a disaster proportion in Franklin County, Kansas;

 

WHEREAS, it is foreseeable that such conditions will create obstructions which endanger health, safety, and welfare of persons and property within the border of Franklin County, Kansas;

 

THEREFORE, BE IT RESOLVED

BY

  THE BOARD OF FRANKLIN COUNTY COMMISSIONERS,

 

That the Franklin County Board of County Commissioners, under and by virtue of the authority vested in it by K.S.A. 48-932 does hereby recognize its ability to proclaim that a state of local disaster exists.

 

IT IS FURTHER RESOLVED AND PROCLAIMED that the area within the border of Franklin County, Kansas covered by this resolution is the entire area of Franklin County, Kansas.

 

BE IT FURTHER RESOLVED, that the Board has all the rights and/or powers to perform said functions as are vested in said Board by and through the provisions of the Kansas Emergency Preparedness Act and K.S.A. 48-901 et seq.

 

BE IT RESOLVED that in the event of the absence of the Chairman of the Board of Commissioners and a majority of the Board of County Commissioners from the County, or the incapacity or unavailability of the Chairman of the Board of County Commissioners and a majority of the Board of County Commissioners, the Franklin County Administrator  is authorized to declare a state of local disaster emergency for Franklin County, Kansas, provided a member of the Board of County Commissioners of Franklin County, Kansas shall be informed by the quickest means of communication available.

This Resolution shall be in full force and effect following its passage by the Board of County Commissioners and its subsequent publication in the official county newspaper.

 

WHEREUPON, the Board of County Commissioners of Franklin County, Kansas, passes and adopts this Resolution in regular session on this 11th day of April, 2007.
