RESOLUTION NO. 07-071      

A RESOLUTION ESTABLISHING AN EMERGENCY TELEPHONE TAX

That pursuant to K.S.A. 12-5302,  Franklin County may establish and operate a emergency telephone service and to pay to such service through the imposition of an emergency telephone tax in that territory within the jurisdiction of the respective governing body for which emergency telephone service has been contracted; and

WHEREAS, the Board of County Commissioners of Franklin County, Kansas, approved such emergency telephone service and telephone tax through resolution 90-10 adopted on the 2^nd day of July, 1990; and

WHEREASA, the Board of County Commissions has approved the emergency telephone service and telephone tax since its original adoption and in resolution 04-74 extended said tax until December 1, 2007; and

WHEREAS, the Board of County Commissioners of Franklin County, Kansas, has determined that, for the protection and preservation of the public health and safety, that the operation of such emergency telephone system is beneficial and should be continued; and

THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF FRANKLIN COUNTY, KANSAS

That an emergency telephone tax, in an amount of seventy-five cents ($.75) per month per exchange access line or its equivalent, as defined by K.S.A. 12-5301, be imposed in those portions of the territory within the jurisdiction of the Board of County Commissioners of Franklin County, Kansas, and for which emergency telephone service has been contracted, pursuant to K.S.A. 12-5301 through K.S.A. 12-5304 inclusive.

Further, such tax shall be imposed effective December 1, 2007 and shall continue thereafter until and unless modified by the Commission. 

     Passed and adopted in regular session in Ottawa, Franklin County, Kansas this 7^th day of November 2007, by the Board of Franklin County Commissioners.
