RESOLUTION NO. 08-030

 

A RESOLUTION TO VACATE CERTAIN STREETS AND ALLEYWAYS IN THE TOWN OF CENTROPOLIS, FRANKLIN COUNTY, KANSAS

 

                WHEREAS, the Franklin County Commission authorized notice of a proposed vacation of  certain streets and alleyways in the town of Centropolis, Franklin County, Kansas; and,

               

                WHEREAS, the Notice of Public Hearing was published in the official county newspaper on June 6, 2008; and,

 

                WHEREAS, notice of the proposed vacation was mailed by certified mail, return receipt requested, to all landowners of record as required by K.S.A. 68-102a notifying said landowners of the proposed vacation and of their right to protest said vacation; and,

 

                WHEREAS, a hearing was held on July 2, 2008, for anyone wishing to protest a closing of the particular streets and alleyways and there were no protests received;

 

BE IT THEREFORE RESOLVED

BY

THE BOARD OF COUNTY COMMISSIONERS OF FRANKLIN COUNTY:

 

                That the following streets and alleyways are not a public utility by reason of neglect, non-use, or inconvenience and that said streets and alleyways have become practically impassable and the necessity for said streets and alleyways as public utilities does not justify the expenditure of the necessary funds to repair said streets and alleyways or put the same in condition for public travel and therefore said streets and alleyways are hereby vacated:

 

10th Street between Centropolis Avenue and the north line of Block 52 and Block 53 in the town of Centropolis, Section 30, Township 15 S,  Range 19 E of the 6th P.M., Franklin County, Kansas.

               

All alleyways in Blocks 52 and 53, in the town of Centropolis, Section 30, Township 15 S, Range 19 E of the 6th P.M., Franklin County, Kansas;

 

This Resolution shall be in full force and effect following its passage by the Board of County Commissioners and its subsequent publication in the official county newspaper.

 

                WHEREUPON, the Board of County Commissioners of Franklin County, Kansas, passes and adopts this Resolution in regular session, at its chambers in Ottawa, Franklin County, Kansas, this  9th day of July, 2008.
