RESOLUTION NO: 09-12
A RESOLUTION MODIFYING THE FINGER PRINT PROCESSING FEE FOR CERTAIN INDIVIDUALS CONVICTED, DIVERTED, ADJUDICATED AND/OR DIVERTED IN PRE-ADJUDICATION PROGRAMS IN FRANKLIN COUNTY
That pursuant to K.S.A., any adult, convicted or diverted, or juvenile adjudicated or diverted under a pre-adjudication program, pursuant to K.S.A. 22-2906 et seq., or K.S.A. 38-1635 et seq., of a misdemeanor or felony contained in chapters 8, 21,41 or 65 of the Kansas Statutes Annotated, are required pursuant to K.S.A. 21-2501, or K.S.A. 38-1611 to be fingerprint, and;
WHEREAS, the Sheriff of Franklin County, Kansas must collect said fingerprints at cost to his department in terms of manpower and supplies, for adult offenders, and;
WHEREAS, the Juvenile Detention Center of Franklin County, Kansas must collect said fingerprints at cost to the department in terms of manpower and supplies, for juvenile offenders, and;
WHEREAS, the District Curt may collect from individuals who are convicted or diverted a separate court cost as a processing fee for each person who is fingerprinted by the Franklin County Sheriff’s Department or the Franklin County Detention Center, and;
WHEREAS, the County Commission in Resolution 02-55 established a fingerprint processing fee for individuals convicted, adjudicated or diverted in the amount of $35.00.
WHEREAS, the County Commission, due to increases in cost of operation and supplies is increasing this fee to $45.00 a person for every individual convicted, adjudicated or diverted in Franklin County.
NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners of Franklin County do hereby That the Board of County Commissioners hereby declares that the Franklin County Sheriff’s Office and the Franklin County Juvenile Detention Facility are entitled to a processing fee for fingerprinting individuals convicted, adjudicated or diverted and the Clerk of the District Court shall collect an amount of Forty Five Dollars ($45.00) as a processing fee for each person fingerprinted, in addition to and not in substitution for any and all other fines, penalties and costs provided for by law for such offenses, and;
The Clerk of the District Court shall turn over, regularly, to the Treasurer of Franklin County, Kansas the processing fees above provided. The Treasurer shall distribute the money to the general fund to either the Sheriff’s Department or the Juvenile Detention Center based on who took the fingerprints.
This Resolution shall be in full force and effect upon its publication in the official county newspaper.
